There are plenty of free emulators for WoW, you can find a whole list here, or you can just go directly to the currently top rated one (and the one I play on) here.
There's also a SWG emulator in beta that's trying to return SWG to it's pre combat "upgrade" state here.

To my knowledge, as long as the emulators don't make any money for their creators, it should be perfectly legal.

No, its still illegal as they are stealing Textures/Sound/Pictures and other stuff from the original game along with the game mechanics.

Copying a movie and putting your name on it and removing the copy protection and giving it to everyone you meet is still stealing the movie :-P

Its also the same reason why EA will not allow people to use the models/textures of the orignal games in any mods.   They are allowing people to use their engine but not the other stuff.   The MMO companys are not allowing the emulator people to use their product, they just are.    Only reasons they don't get shut down is 1) small time 2) sometimes hard to catch them 3) in the case of the SWG one, it still doesn't work :-P
