I got permission from Herb himself to use this game. Although he doesn't know its name yet wink
Whats it matter anyway? You can still purchase it, which means it's commercial.

Unless I'm using "third party" in the wrong way, in which case I mean it's not being made by any of the major game developers (EA, Vivendi, etc.).
